⤷ What is sexual harassment under R.A. No. 7877?
It covers sexual harassment committed by an employer, employee, manager, supervisor, agent of the employer, teacher, instructor, professor, coach, trainor, or any other person who, having authority, influence or moral ascendancy over another in a work or training or education environment, demands, requests or otherwise requires any sexual favor from the other, regardless of whether the demand, request or requirement for submission is accepted.
⤷ What instances of sexual harassment are covered under R.A. No. 7877?
It includes acts of sexual harassment committed in a work-related or employment environment, and in an education or training environment.
⤷ What kinds of sexual harassment are covered?
R.A. No. 7877 covers the following:
- Quid Pro Quo– the offender asks for something in exchange for something. This may be in the form of asking sexual favors in exchange for more favorable conditions. Basically, you are being asked to exchange sexual favors in return for receiving something.
- Hostile environment- as a result of the act of sexual harassment, a hostile environment is created for the victim. Here, no exchange is requested, but the working or educational environment of the victim is made hostile due to the acts of sexual harassment. This may take the form of the victim being afraid to come back to work/school, or in the disrupting of their normal work/study due to the acts of sexual harassment.
⤷ Should there be a demand or request for sexual favors before it is considered sexual harassment?
No. It is true that this provision calls for a “demand, request or requirement of a sexual favor.” But it is not necessary that the demand, request or requirement of a sexual favor be articulated in a categorical oral or written statement. It may be discerned, with equal certitude, from the acts of the offender.
Likewise, it is not essential that the demand, request or requirement be made as a condition for continued employment or for promotion to a higher position. It is enough that the respondent’s acts result in creating an intimidating, hostile or offensive environment for the employee. (Domingo v. Rayala, G.R. No. 155831, 18 Feb. 2008)
⤷ Does R.A. No. 7877 look at the gender of the offender and the victim?
No. The law does not require the offender or the victim to be of any specific gender. This means that the law punishes sexual harassment committed between a man against a woman, a woman against a man, a man against another man, and a woman against another woman.
⤷ What legal remedies are available against sexual harassment?
The law provides for civil, criminal, and administrative liability on the part of the offender for acts of sexual harassment under R.A. No. 7877. Moreover, these may proceed independently of the others. The option of which remedy to avail of is based on the discretion and choice of the victim.
⤷ Until when can I file a case for sexual harassment under R.A. No. 7877?
The law provides for a prescriptive period of three (3) years. This means that any action arising from a violation of R.A. No. 7877 should be filed within 3 years from the time of commission.

It includes catcalling, wolf-whistling, unwanted invitations, misogynistic, transphobic, homophobic and sexist slurs, persistent uninvited comments or gestures on a person’s appearance, relentless requests for personal details, statement of sexual comments and suggestions, public masturbation or flashing of private parts, groping, or any advances, whether verbal or physical, that is unwanted and has threatened one’s sense of personal space and physical safety, and committed in public spaces such as alleys, roads, sidewalks and parks.

It includes the following:
- An act or series of acts involving any unwelcome sexual advances, requests or demand for sexual favors or any act of sexual nature, whether done verbally, physically or through the use of technology that has or could have a detrimental effect on the conditions of an individual’s employment or education, job performance or opportunities;
- A conduct of sexual nature and other conduct-based on sex affecting the dignity of a person, which is unwelcome, unreasonable, and offensive to the recipient, whether done verbally, physically or through the use of technology;
- A conduct that is unwelcome and pervasive and creates an intimidating, hostile or humiliating environment for the recipient.
